1. Liability
   We strive to provide high-quality services and work with great care on the development of custom websites. However, we accept no liability for direct or indirect damage resulting from the use of our services. The use of our services is entirely at your own risk.

 

2. Payment term
   The payment term for our services is 14 days after the invoice date, unless otherwise agreed in writing. In the event of late payment, we are entitled to charge statutory interest and any collection costs.

 

3. Retention of title
   The ownership of the services provided, including the developed websites, remains with Monadius until full payment has been received.

 

4. Guarantee
   We strive to provide high-quality and well-functioning websites. During a period of 1 month and 7 days after delivery, we will repair any defects free of charge, unless these are the result of adjustments by the customer or third parties.

 

5. Delivery conditions
   The delivery period of the websites is determined in mutual consultation and confirmed in writing. We strive to use this period as accurately as possible, but cannot guarantee exact delivery dates.

 

6. Force majeure and force majeure
   In the event of force majeure or other unforeseen circumstances that prevent us from fulfilling our obligations, we are entitled to suspend the performance of our services or to terminate the agreement. We will inform the customer of this as soon as possible.

 

7. Intellectual property
   • The intellectual property of the websites developed by Monadius remains the property of Monadius, unless otherwise agreed in writing.

    

   • It is not permitted to copy, reproduce or otherwise use the websites or parts thereof without prior written permission from Monadius.

 

8. Cancellation and changes
   • In the event of cancellation of the agreement after approval of the quotation and after the work has started, the customer owes 25% of the total amount as cancellation costs.

    

   • Any costs already incurred and work performed up to the moment of cancellation will be charged in full.

    

   • Changes to the order after approval of the invoice are possible, but may entail additional costs. The customer will be informed of this in a timely manner and must give written approval before the changes are implemented.

 

9. Confidentiality
   • Monadius treats all confidential information it receives from the customer with the utmost care.

    

   • The customer agrees that Monadius will only use the information provided to perform the agreed services.

    

   • For more information about how Monadius handles privacy and personal data, please refer to the privacy policy, which is available on the website.

 

10. Reflection period
    There is no legal right to a reflection period for the custom websites supplied, because they have been developed specifically for the customer and are not standard products.

 

11. Additional provisions
    In addition, we may apply additional provisions that specifically apply to the services provided by us. These additional provisions will be determined in consultation with the customer and agreed in writing.
